Motor Insurance Rule Changing From 15th December 2026

Motor Insurance Rule Changing From 15th December 2026

IRDAI’s new four-layer motor insurance structure starts on 15th December 2026. Understand the change and why a separate personal accident policy can offer broader financial protection.

Your vehicle Is Insured. But are you financial protected if an accident changes Your Life?

Most people purchase a motor insurance to protect their vehicle and comply with legal requirements but there is another important question every rider must ask themselves,

“If you suffer a serious accident and survive with a permanent disability or a temporary disability, will your motor insurance provide enough financial protection for you and your family?”

From 15th December 2026 onwards, IRDAI is introducing a four-layer motor insurance structure for private car and two wheelers. This will make it easier for customers to understand the different covers included in their motor insurance policies and choose the best protection as per their requirements. These changes also make it important to understand the differences between personal accident cover under a motor insurance policy and a separate, standalone personal accident policy.

What is Changing in Motor Insurance From 15th December 2026?
As per IRDAI Circular No. Ref: IRDAI/NL/CIR/MISC/145/11/2026 dated 2nd November 2026, insurers must offer a four-layer structure for private and two wheelers.

Motor Insurance Section

Nature of Cover

Section I – Third Party Liability

Mandatory

Section II – Legal Liability to occupants / Pillion Riders

Optional

Section III – Personal Accident Cover

Owner insured cover mandatory, additional cover for occupants, pillion riders and other drivers optional

Section IV – Own Damage Cover

Options

What does each section mean?

· Third Party liability is mandatory. This covers the insured vehicle owner’s liability for injury, death or property damage caused to third parties, subject to the policy.

· Legal Liability to Occupants is optional. This provides specified legal liability protection for occupants of a private car or pillion riders, including employees travelling in the vehicle. It is distinct from personal accident cover.

· Personal Accident Cover with mandatory and optional components. Personal accident cover fro the own - insured remains mandatory under the new structure. Additional personal accident cover for occupants, pillion riders and drivers other than the owner driver can be selected optionally.

· Own Damage Cover is optional. This covers loss or damage to the insured’s vehicle, subject to riders and policy terms and conditions. Insurers must also provide a customer option form and Customer Information Sheet (CIS) showing the selected covers and the premium charged for each section.

Why is Motor Insurance Personal Accident Cover Not Enough?
The personal accident cover associated with motor insurance is connected to the vehicle and the insured owner driver arrangement. It is an important protection, but it should not automatically be treated as a substitute for a standalone personal accident policy.

A separate personal accident policy, on the other hand, can provide insurance cover against covered accidents across different situations, subject to its definitions, exclusions and conditions.

Comparison

Motor Insurance PA Cover

Standalone Personal Accident Policy

Main Purpose

Personal Accident protection connected with the insured vehicle and owner driver

Broader personal accident protection

Coverage Context

As defined by the motor policy

Covered accidents as defined by the PA Cover

Accidents outside the insured vehicle

Generally not covered under the vehicle linked owner driver PA cover

May be covered, subject to policy terms

Permanent Disability Benefits

Depends on the applicable motor PA Cover

May include PTD and PPD benefits

Temporary disability income

Not generally the main purpose of the basic motor PA Cover

May be available through TTD benefits

Additional Benefits

As specified in the motor policy

May include fractions, burns, mobility, education and other benefits

The most important distinction one must understand, is that a standalone PA policy is not necessarily a replacement for motor insurance PA cover. It is an additional layer of personal financial protection.

What Can a Separate Personal Accident Policy Cover?
A standalone personal accident policy may offer significantly more than accidental death protection. Now, depending on the insurer and the plan selected, the benefits can include a variety of options such as

Benefit

How it may help

Accidental Death

Lump sum payment to the nominee following a covered accidental death

Permanent Total Disablement (PPD)

Financial Benefit for specified permanent and Total disabilities

Permanent Partial Disablement (PPD)

Percentage based payout for specified permanent partial disabilities

Temporary Partial Disablement

May provide a defined benefit for qualifying temporary partial disability, if included

Fracture Benefit

Fixed payout for specified fractures

Burns Benefit

Benefit for qualifying burn injuries

Child Education Benefit

Financial Support for children’s education following specified events

Mobility Cover

Assistance towards eligible equipment such as wheelchairs, artificial limbs

Nursing Costs

Cover for eligible nursing expenses

Repatriation of Mortal Remains

Assistance towards eligible transportation expenses

Disappearance cover

Benefit in specified circumstances involving disappearance following an accident

Loyalty Bonus

Additional sum insured or bonus, if provided under the selected product

Accidental Hospitalization

Specified accident-related hospital benefits

Domestic Road Ambulance

Financial Assistance for eligible reconstruction procedures

The above details are just a basic outline and not every policy provides all the above explained benefits. Some are optional, have separate limits or are available only under specific plans.

The Benefit worth Paying Particular attention to – Temporary Total Disablement
Imagine a self employed professional earning Rs 1.5 Lakh per month suffers multiple fractures in a road accident. The accidental hospital expenses may get covered under health insurance policy but what happens if the advises 12 weeks of complete rest?

· Home loan EMI continues
· Children’s school fees will continue
· Utility bills, household expenses continue
· Business income can stop anytime
· Investments may have to be liquidated or stopped to meet monthly commitments

A personal accident policy with a TTD benefit may provide a weekly cash payout during the approved period of disability. For example, if the policy offers a 1% of Rs 50 Lakh sum insured per eligible week, then the weekly benefit would be around Rs 50,000/-. The actual payment may depend on the policy’s weekly limits, maximum duration, disability definitions, medical evidence and insurer approvals.

How much Personal Accident Cover can you Consider?
The appropriate sum insured depends on your income, occupation, financial commitments and existing protection. As an example, illustration, the premium figures are shared below but for multi-year personal accident covers, the insurance company offer certain premium discounts as well.

Personal Accident Sum Insured

Example Quoted Premium

Rs 30 Lakh PA Cover

Rs 6,240/-

Rs 50 Lakh PA Cover

Rs 11,242/-

Rs 1 Crore PA Cover

Rs 21,569/-

Rs 2 Crore PA Cover

Rs 42,225/-

The figures mentioned above are based on the quotation details supplied for this article. They should not be treated as standard market rates or guaranteed premiums. It is always better to confirm with the insurer multiple details such as policy duration, applicable taxes, eligibility, PED related queries, Income proof requirements, benefits and current quotation before making a purchase. The actual entry age, renewal conditions, premium structure and income eligibility must be checked against the insurer’s current product documents.

The offering details shared could also mention similar details such as

· Entry age between 18 years to 60 years
· Lifetime renewal option, subject to policy terms & conditions
· Multi-year policy tenure premium discounts
· Income proof through documents such as ITR, Form 16, Salary Slips etc
· Smaller cover options below Rs 30 Lakh cover may be available as well.

Is a Standalone Personal Accident Policy Worth Considering?
In the views of an insurance consultant, yes. Particularly if you are the primary earning member of your family. Consider a situation where,

· You are a salaried professional with home loan EMIs
· You are self employed and your income depends on your ability to work
· You are a business owner whose business operations depend on your physical involvement
· You have depending parents, children or other family members
· You travel frequently for work or personal reasons

A motor insurance PA policy cover is useful for the specific vehicle related protection but your financial responsibilities do not disappear when you step out of your own vehicle. A standalone PA policy can help bridge this protection gap by covering specified accidental events beyond the limited context of your vehicle policy.

Your Insurance Protection Should Have Three Separate Layers
Do not confuse the purpose of PA Insurance. A health insurance helps pay for eligible medical and hospital expenses. A term life insurance product provides financial protection to your dependents in the event of your death whereas a personal accident insurance can provide financial benefits following covered accidental death or disability, including temporary disability benefits where selected.

Each policy addresses a different financial risk. Having one does not automatically eliminate the need for the other.

Final Takeaway
The new IRDAI motor insurance structure is an important step towards better transparency. From 15th December 2026 onwards, customers will be able to see the different motor insurance components and make more informed choices about their coverage but always remember, your motor insurance plan protects against specified vehicle related risks and not your personal risks.

Your personal accident policy can provide a separate layer of protection for your risk, mobility and financial responsibilities. Do not purchase personal accident cover in a hurry because it appears as an option in a motor insurance proposal. Understand what is covers, what is excludes and whether the benefit is sufficient for your family’s needs.

Your vehicle can be repaired or replaced. But if an accident affects your ability to earn, the financial consequences can continue long after you leave the hospital.

Protect your vehicle, protect your health and do not overlook the financial value of protecting yourself against accidental disability.
